  1. Use of the Site

The User undertakes, in the context of using the site, not to engage in acts of any nature whatsoever that would be contrary to the Law, would undermine public order, or the rights of the Professional or third parties. In particular, without this list being exhaustive, the User undertakes, in his use of the site, to respect the following rules:

- provide accurate information when registering and using the site;

- not to use a false identity with the aim of deceiving others;

- comply with applicable laws and respect the rights of third parties, as well as these contractual provisions;

- use the Sites in a fair manner, in accordance with its professional purpose exclusively, and in accordance with the legal and regulatory provisions and practices in force;

- respect the intellectual property rights relating to the content provided by THE PROFESSIONAL and by other Users, as well as the intellectual property rights of third parties;

- not to disseminate data, information or content of a defamatory, abusive, obscene, offensive, violent or inciting violence, or of a political, racist or xenophobic nature and, in general, any content which would be contrary to the laws and regulations in force or to good morals;

In the event of a breach by a User of one or more of these rules, MIKIZI reserves the right to unilaterally suspend and/or terminate registration and to delete the disputed content and messages, temporarily or permanently, without any compensation.

  1. Intellectual Property

The Site, its content and all the elements that compose it are protected under intellectual property law.

MIKIZI is the owner or holder of the exploitation rights (for having regularly acquired them from third parties) of all the elements that make up the site, such as brands, logos, texts, photographs and images, graphics, video, sound and animation data, software, source codes, databases.

The User is only authorized to view the site and use the elements that compose it for personal and private purposes and for the strict purposes of consulting said Sites, excluding any public viewing or distribution.

Consequently, MIKIZI cannot be held responsible for interruptions and suspensions of access to the Sites, errors and bugs, the presence of viruses, or other computer infections, fraudulent intrusion by a third party resulting in a modification of the information made available on the Site as well as their consequences for the User and more generally for any damage, direct or indirect, whatever the causes, origins, nature or consequences, caused by anyone's access to the site or the impossibility of accessing it, as well as the use of the site and/or the credit given to any information coming directly or indirectly from the latter.

In addition to consulting the various areas of the site, the User has the possibility, on the said site, to place orders for products offered for sale by MIKIZI.

As specified in the General Conditions of Sale in force, in the event of an order by the User, then considered as a Customer, the latter must have previously created a customer account using the proposed form.

The requested information followed by an asterisk must be provided and the User must be of legal age, i.e. 18 years of age or older, otherwise no customer account can be created.

The User is responsible for all data, content and information that he/she has uploaded as well as for all content that he/she has provided. The User acknowledges that MIKIZI does not exercise a priori control over said content and data and that it has no general obligation to monitor User data and content stored and disseminated via the Site.

The User acknowledges that, in the event of reporting by another User, MIKIZI may delete published content which appears to be contrary to the requirements referred to in this paragraph.

The transmission of any opinion or comment by the User entails, free of charge, the transfer of exploitation rights (right of reproduction, right of representation, right of distribution, right of adaptation and translation in particular) to MIKIZI, which may thus publish it in whole or in part on the Site but also exploit it in whole or in part, on any medium and for any purpose whatsoever.

MIKIZI may modify the terms of these T&Cs at any time. These modifications are binding on the User as soon as they are posted online. It is therefore recommended that the User regularly consult the T&Cs to be aware of these new conditions.

Any failure by the User, regardless of their location, to comply with any of the provisions of these T&Cs and, more generally, any difficulty relating to their execution, interpretation or validity, are subject to French law and French jurisdiction.
